NORTH PROVIDENCE, R.I. -

A man suing Providence police for alleged brutality has been charged with misdemeanor assault and resisting arrest in North Providence.

North Providence police arrested 25-year-old Luis Mendonca on Sept. 2.

According to a police report obtained by the I-Team, officers responded to a house party and found Mendonca on top of another man, and punching him in the face.

According to the report, Mendonca was ordered several times to place his hands behind his back and he refused.

Medonca's attorney, Aponte Cardona, told NBC 10 that his client wasn't looking for trouble and that he was looking to help a friend.

"Corey Garabedian, who is a longtime, childhood friend of Luis, was attacked by certain members, certain people at the party. Corey Garabedian is a veteran and he's also an amputee. During the scuffle with Corey, someone took his prosthetic and started tossing it around," Cardona said.

Mendonca is suing Providence police for alleged brutality. He was beaten unconscious in October 2009 after city officers stopped him on suspicion of theft and trespassing. Surveillance video showed a police officer using a flashlight to beat Mendonca, who was in handcuffs.

Detective Robert DeCarlo was convicted of assault in the beating, but the conviction was overturned because of prosecutorial misconduct.

The charge violates Mendonca's probation and has landed him in the Adult Correctional Institutions for 90 days.

"Luis was more concerned with his friend and getting the prosthetic back then getting himself in trouble so it wasn't like, 'Here we go again.' It was just like wrong place, wrong time," Cardona said.
