MIDDLETOWN, R.I. -

A Middletown woman is accused of driving drunk with her two young children in the vehicle.

Erin Hebel, 51, was charged with driving under the influence and refusal to submit to a chemical test. She is due in Newport District Court on Friday.

Police said they got a call at about 5:45 p.m. on Feb. 22 to check on the condition of a driver on Aquidneck Avenue.

The officer who responded detailed what he saw in a police report obtained by NBC 10.

The officer said he pulled into a 7-Eleven store at the corner of Aquidneck and Green End avenues when he observed a tan SUV drive by.

The car took a left onto Green End Avenue and the officer followed. The officer said he observed the vehicle swerving in its lane of travel and crossing the white fog line, nearly missing a mail box.

From Green End Avenue, the officer said he observed the driver take a right onto Morrison Avenue. He said she ran over the curb, clipped a snow bank and crossed the travel lane, ending up with her left tires on the grass.

Police identified the driver as Hebel. Her two passengers were her two daughters, 1 and 2 years old.

Police said a cup in the center console with brown liquid had a positive reading for alcohol. Police also said inside Hebel's purse was an empty pint of vodka, a full pint of vodka, and prescription medication.

After some field sobriety tests, Hebel was taken back to police headquarters, where police said she initially agreed to take a chemical test, but said, "Well, I know that I have alcohol in my system. I just want to know what the consequences are."

Police said after speaking with her lawyer, Hebel refused the chemical test.

There was no comment at Hebel's home Tuesday.

Police said they contacted the state Department of Children, Youth and Families.
