Teen pleads not guilty to fatal crash

WARWICK, R.I.—A 17-year-old boy accused in a car crash that killed a woman will remain free on bail after pleading not guilty to the charges.

Graeme Kapko, who is being tried as an adult, faces charges of driving to endanger with death resulting, driving to endanger with personal injury resulting and possession of alcohol by a minor.

He was arraigned Friday in Kent County Superior Court and released on $50,000 personal recognizance bail.

Police said Kapko was driving 85 miles per hour on Route 2 in Warwick in March when his car struck a vehicle driven by 46-year-old Luisa Avila, who was returning home from work.

Though police found alcohol in Kapko’s car, he was not given a breathalyzer test and not charged with drunken driving.

Can I have an explanation of how a 17 year old, driving 85 MPH on Route 2, with alcohol in his car, hits and kills a woman, and is not given a breathalyzer test?!  Have to wonder who he knows to get away with that.  My condolences to the family of the INNOCENT victim of this teenager.
