NEW BEDFORD, Mass.—A man was arraigned in New Bedford District Court on Monday after police said he was drunk when he struck and killed a man who was crossing the street.
Rui Gomes, 40, of New Bedford, was charged with driving under the influence and operating to endanger. He was released on $5,000 bail.
The accident occurred at about 9:50 p.m. on Saturday as the victim was leaving the Dipper Café at 1367 Purchase St., police said.
The victim, whose name has not been released, was transferred to St. Luke’s Hospital to Rhode Island Hospital in Providence. He later died on Sunday.
Anthony Guadalupe, Gomes attorney, said the victim darted in front of his client’s car and said there was no proof that Gomes was drunk at the time of the accident.
New Bedford police are disputing that claim and added that other drivers did manage to see the victim and avoid hitting him.
